It
is understood that this studio is the exclusive official photographer
retained to perform the photographic services requested on this contract.
It is understood that no other photographer, amateur or professional, shall
be allowed to photograph at the wedding while the photographer is working.

All
proofs are yours to keep. Proofs are provided in the format indicated
on the wedding package selected. All other photographic materials, including
but not limited to negatives, digital files and transparencies, will be the
exclusive property of Pensacola Photography.

No
part of any order, including proofs or previews, will be delivered until the
balance is paid in full.

Pensacola Photography will follow any rules and regulations of the church or
other location, or the minister or officiate performing the ceremony,
regarding photography during the ceremony. Contracting party is responsible
for providing us with these rules and regulations in advance, so that we may
bring the proper equipment to take photographs during the actual ceremony.

Pensacola Photography reserves the right to use photographs for display,
website, portfolio, samples, promotions, editorial and promotional use.

It
is illegal to copy or reproduce these photographs in any manner without
Pensacola Photography’s permission, and violators of this federal law will
be subject to its civil and criminal penalties. This includes scanning for
printing in any manner.

Overtime: Because we may book another photographic session before or after
yours, it is advisable that you book the package with the number of hours
that best suits your wedding.

Upon
signature and receipt of your deposit, Pensacola Photography will reserve
the time and date agreed, and all deposits are non-refundable, even if the
date of the wedding is changed or the wedding is canceled. If the date of
the wedding is changed, we will review on a case by case basis to determine
if the deposit will carry forward to the new date. If you must change the
date, let us know as early as possible so we can review the case.

In
case of inclement weather, rain, tropical storm or hurricane prohibiting the
photography and setup of outdoor wedding, Pensacola Photography and White
Sands Weddings will work with you to reschedule or relocate the wedding, and
we will be happy to make arrangements for beach photography on another date
or a later time. Pensacola Photography is not liable for a wedding not
taking place at the original location or time due to weather. It is
advisable to have an alternate plan for a sheltered ceremony so that the
actual ceremony can take place on the scheduled date.

Full
value of the wedding is earned forty-eight hours prior to the wedding.
Notice to cancel must be provided forty-eight hours prior to the wedding.
If wedding is canceled, deposit is forfeited. If notice of cancellation is
not given prior to forty-eight hours of the wedding time, all charges are
considered earned and are due. Cancellation prior to forty-eight hours must
occur through client speaking directly with a representative of Pensacola
Photography, or sending an email to arrive prior to forty-eight hours before
wedding time. The email address(s) and phone number(s) posted on Pensacola
Photography’s website at www.pensacolaphoto.com will govern contact
information.

Pensacola Photography guarantees to have one of our professional
photographers on time for your wedding. If Pensacola Photography cannot
perform this agreement due to a fire or other casualty, strike, act of God,
or other cause beyond control including unavoidable traffic delays or
mechanical failure, Pensacola Photography shall return the amount to the
client but shall have no further liability with respect to the contract.
This return of payment does not include situations where unavoidable
circumstances may delay our arrival, and we have attempted to contact you in
route. This limitation on liability shall also apply in the event that the
photographic materials are damaged in processing, lost through camera
malfunction, lost in the mail, or otherwise lost or damaged without fault on
the part of Pensacola Photography. In the event Pensacola Photography fails
to perform for any other reason, Pensacola Photography shall not be liable
for any amount in excess of the retail value of the client’s order.

Client is aware that color dyes in photography may fade or discolor over
time due to the inherent qualities of dyes, and client releases Pensacola
Photography from any liability for any claim whatsoever based upon fading
and/or discoloration due to such inherent qualities.

The
charges in this contract are based on Pensacola Photography’s standard price
list. This price list is adjusted periodically and future orders shall be
charged at the prices in effect at the time the order is placed.

Wedding packages require deposit amounts listed in the package description
due at signing of this contract, and the remainder is due two weeks prior to
the wedding date, payable by cash, check, credit/debit card, money order or
certified check. All payments should be made payable to Pensacola
Photography.

Personal checks returned due to insufficient funds will be charged a $50.00
fee, and remaining balances must be paid by credit/debit card, cash, money
order or certified check. Any charges incurred to collect payment due
Pensacola Photography will be the responsibility of the contracting party.

Package enlargements, allowances, and other items included in the package or
prepaid with this contract must be ordered within 120 days of the wedding
date, or be subject to current standard prices, should the standard prices
increase during the 120 days. Order instructions will be supplied to you
upon delivery of your proofs, or are available online at
www.pensacolaphoto.com.

This
agreement incorporates the entire understanding of the parties. Any
modifications of this contract must be in writing and signed by both
parties. Any waiver or a breach or default hereunder shall not be deemed a
waiver of a subsequent breach or default of either the same provision or any
other provision of this agreement. This agreement shall be governed by the
laws of the State of Florida.

photographs in the event of illness. In the event of such substitution,
Pensacola Photography warrants that the photographer taking the photographs
shall be a competent professional.

Military: We support and want to extend our appreciation to all military
personnel. If orders are changed requiring a change in the portrait date all
deposits will be forwarded.
